Whether you are for Obama or not, read what a constitutional attorney has to say about the new health care
This is a reprint of an article I received explaining what is happening to us today. What the attorney did not mention but is in the bill is it even affects our Real Estate transactions. There will be a 3.8% transfer tax imposed on the sale of homes.

The Truth About the Health Care Bills - Michael Connelly, Ret. Constitutional Attorney
Well, I have done it! I have read the entire text of proposed House Bill 3200: The Affordable Health Care Choices Act of 2009. I studied it with particular emphasis from my area of expertise, constitutional law. I was frankly concerned that parts of the proposed law that were being discussed might be unconstitutional. What I found was far worse than what I had heard or expected.
To begin with, much of what has been said about the law and its implications is in fact true, despite what the Democrats and the media are saying. The law does provide for rationing of health care, particularly where senior citizens and other classes of citizens are involved, free health care for illegal immigrants, free abortion services, and probably forced participation in abortions by members of the medical profession.
The Bill will also eventually force private insurance companies out of business, and put everyone into a government run system. All decisions about personal health care will ultimately be made by federal bureaucrats, and most of them will not be health care professionals. Hospital admissions, payments to physicians, and allocations of necessary medical devices will be strictly controlled by the government.
However, as scary as all of that is, it just scratches the surface. In fact, I have concluded that this legislation really has no intention of providing affordable health care choices. Instead it is a convenient cover for the most massive transfer of power to the Executive Branch of government that has ever occurred, or even been contemplated If this law or a similar one is adopted, major portions of the Constitution of the United States will effectively have been destroyed.
The first thing to go will be the masterfully crafted balance of power between the Executive, Legislative, and Judicial branches of the U.S. Government. The Congress will be transferring to the Obama Administration authority in a number of different areas over the lives of the American people, and the businesses they own.
The irony is that the Congress doesn't have any authority to legislate in most of those areas to begin with! I defy anyone to read the text of the U.S. Constitution and find any authority granted to the members of Congress to regulate health care.
This legislation also provides for access, by the appointees of the Obama administration, of all of your personal healthcare direct violation of the specific provisions of the 4th Amendment to the Constitution information, your personal financial information, and the information of your employer, physician, and hospital. All of this is a protecting against unreasonable searches and seizures. You can also forget about the right to privacy. That will have been legislated into oblivion regardless of what the 3rd and 4th Amendments may provide.
If you decide not to have healthcare insurance, or if you have private insurance that is not deemed acceptable to the Health Choices Administrator appointed by Obama, there will be a tax imposed on you. It is called a tax instead of a fine because of the intent to avoid application of the due process clause of the 5th Amendment. However, that doesn't work since there is nothing in the law that allows you to contest or appeal the imposition of the tax, it is definitely depriving someone of property without the due process of law.
So, there are three of those pesky amendments that the far left hate so much, out the original ten in the Bill of Rights, that are effectively nullified by this law. It doesn't stop there though.
The 9th Amendment that provides: The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people;
The 10th Amendment states: The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are preserved to the States respectively, or to the people. Under the provisions of this piece of Congressional handiwork neither the people nor the states are going to have any rights or powers at all in many areas that once were theirs to control.
I could write many more pages about this legislation, but I think you get the idea. This is not about health care; it is about seizing power and limiting rights. Article 6 of the Constitution requires the members of both houses of Congress to "be bound by oath or affirmation to support the Constitution." If I were a member of Congress I would not be able to vote for this legislation or anything like it, without feeling I was violating that sacred oath or affirmation. If I voted for it anyway, I would hope the American people would hold me accountable.
For those who might doubt the nature of this threat, I suggest they consult the source, the US Constitution, and Bill of Rights. There you can see exactly what we are about to have taken from us.

Inner Circle of Investors Disect the Investing Business Model
Recently had the privilege of sitting down with some of the "brightest minds" in the area who actually own and operate Real Estate Investing businesses today. Over a two day intense invitation only meeting, we reviewed everyones business model and picked it apart and put it back together with improvements to move forward and help more people in this restrictive economy.
We looked at and disected the various facets of our individual and team businesses. We discussed marketing, profitability, accounting, cashlow, manpower planning, timing and many important business operational details. It was a very good meeting and I am not much for meetings.

I drove up to Norcross this week for the monthly GA REIA meeting attended by several hundred members and guests. The entry fee was $25 just to listen. I was able and privileged to spend some time with John Adams (well known Real Estate Guru all over the US, Trainer, Radio Show Host, Atlanta Journal Columnist, TV personality, Landlord, and Investor) listening to his views and where he thinks the market is going.
John has a wealth of knowledge and real life experiences building wealth through real estate investing. He has more experience actually doing and running a successful Real Estate business than almost anyone alive today. He and his wife Marjorie, work side by side. She is one smart lady and a CPA. When John speaks on the radio, newspaper, TV, or to a class, people listen. His insight into the market has proven to be correct more times than not.
Here is what I took from his insight. The current economy will not last as change and cycles are inevitable. John has been through four recessions or corrections. John said today is a great time to buy and hold property if you know how. There are many great deals out there right now. John believes in helping people. He also believes everyone needs a written plan for their business. This is something we teach at A O Home Solutions in our training program. People need to take action and not just talk about it if they intend to be investors. Buying homes at the right price is a step in the right direction but only one part of this business. Education and understanding the market cycles is important for success. If you want to be involved now is a great time to get started.

No Room for Sharks in the business
There are a lot of sharks in this business of Real Estate right now. Do not get bit or deal with a shark investor or landlord. Do not get anywhere near those who do not document their deals and use the proper legal forms. If it feels or smells fishy it probably is not the deal you need. I was down at St Simons Island vacationing and catching a few of the lower level sharks recently and a friend snapped the picture of one of the Black tail sharks I caught and then released. There is a lot of talk about Buying foreclosures today. Foreclosures are ok if you understand what you are buying. You are buying a home that someone has lost because they could not pay for it. Chances are they could not pay for months and that means it usually was not kept up either. Chances are when they left they were mad and may have taken it out on the house before they left. Foreclosure homes are always filled with surprises. Yes, you can get a good deal at times but, there may be things missing like the copper pipes or the air conditioner and a clogged septic system or other deficiencies. Foreclosures are houses the bank does not want and can not usually sell the normal route. The banks just want to be rid of it and often do not check everything. You can't check the air with the power off. You can not check for water leaks with the water off and you are buying the foreclosed house as is where is with no warranty and often a limited warranty deed. Some people leave foreclosures in good shape but, remember to do your own checking before you buy and the saying "buyer beware" is appropriate in this case more than ever. Buyer, Sellers, Investors, Agents are you aware of the new rules for RRP?
Renovation, Repair, and Painting (RRP), is the new federally mandated program to deal with lead paint in homes built primarily prior to 1978 or that used certain paint after 1978. The program is effective as of April 22, 2010. It’s important that contractors, real estate agents, Investors, Buyers and Sellers be aware of the rules and the requirements. Failure understand the law could result in a fine of up to $37,500 per day, per violation!
The basic requirement is that work in homes containing lead paint be done by a Certified Renovator. And, it isn’t enough that a contractor be certified, the work must be continually supervised by someone who has taken a HUD approved training course. Spot testing for lead paint must also be done by a Certified Renovator. There are exemptions but you have to know the rules to stay clear of the fines
It is estimated that 35 million homes in the U. S. contain lead paint.
While the EPA has produced a booklet, “Renovate Right,” to address the issues and requirements of the new program, agents are still required to provide the EPA pamphlet, “Protect Your Family From Lead in Your Home,” as a part of the lead hazard disclosure in sales and leases. And those agents who are involved in property management or who recommend contractors, should be familiar with the new rules in order to confirm compliance with RRP.
Those whose business involves homes that may contain lead paint should familiarize themselves with RRP to avoid fines and potential lawsuits.

Happy Buyers A New House

Another Happy Home Buyer

Helping Other Investors Make Money in less than 30 days

Are You Sure You Want a Business Credit Card?

I have students asking about establishing business credit. It’s a myth. As a small business, real estate investor, or general entrepreneur you don’t have a prayer of establishing “business credit.” You will always sign personally for any “credit” your business gets.
The major competitor I had in do-it-yourself asset protection packages went bankrupt a couple of years ago. (Beware! His products are still out there being sold by a half dozen groups. The products are out of date and there is no support – in spite of what you are told.) His company was a ton bigger than mine. It was doing tons of seminars, and the back end sales were huge (ruthless). He had signed personally for all of the company credit cards. That’s the only way you will ever get a business credit card. When his company went bankrupt, he was on the hook for over $10 million. NOT HAPPY! (Not a good asset protection technique either.)
You actually shouldn’t have a business credit card. They are dangerous. Just use a personal card for everything and then pay it each month the way the IRS wants you to.
Your personal credit card is governed by the Credit Cardholders Bill of Rights, but those laws don’t apply to business credit cards. BIG RED FLAG!
Business cards are subject to the whims of the credit card company. The interest rates can be raised at will, even retroactively. Billing cycles can be changed at will. The rules just aren’t the same at all. The real threat a business card represents is the liability of fraud. You lose your card, and you are toast. With a personal card you are liable for $50, but with a business card there is no liability limit. You’re stuck, as a business and personally, because I will guarantee you have signed personally for the card.
So, don’t use a business card. Use a personal card. You will charge everything (personal and business) on the one card. But wait, you can’t comingle money and expect your corporate (LLC) shield to protect you. Comingling money is the number one no no. You’re not comingling money by charging the card. How you make the payment to the card is the issue.
When you get your credit card statement, go down the list and check each charge. (You should always do that anyway.) By each charge, write whether it is business or personal. In my case there are a number of companies, so I have to designate which company the charge applies to. Then add up the business and personal charges. Enclose two checks in the payment envelope; one from your business account and one from your personal account. The credit card company will cash each check and apply it toward the monthly bill. Sometimes we write half a dozen checks and put them in the same envelope.
The IRS actually wants to see the money coming out of each account. If you do it that way, there is no question you are not comingling money. Your asset protection shield is safe. Yes, you could cut one check to the credit card company and then reimburse yourself from your company, but just do the multiple check thing. You can follow the same concept if you pay online. You now have the protection of a personal card, your asset protection shield is intact, and the IRS is happy. Don’t you love a happy IRS?
